Report on the effectiveness of harmonisation of the CEAS, based on the different harmonisation tools

Following the AIDA methodology, the effectiveness of the legal harmonisation will be assessed and analysed with a focus on the national implementation of CEAS legislation, the interpretation of EU law by the Court of Justice of the EU, relevant jurisprudence of the European Court of Human Rights (ECHR), at the national level, including in selected non-EU countries. The evaluation of the implementation of the instruments of the CEAS will be approached through four core themes: 1) asylum procedures, including the operation of the Dublin System; 2) reception conditions for asylum seekers; 3) detention of asylum seekers, and; 4) content of international protection.

Report on ideal-typical CEAS models

Starting from the needs of refugees as the core issue, the deliverable drafts several scenarios by which the CEAS could produce optimal protection results, while also achieving solidarity and equity between Member States. ‘Equity’ in this equation can be defined in alternative ways, e.g. as an outcome of equal numbers, costs, benefits, or realised by means of ‘side payments’. This exercise will be informed by the outcomes of the state-of-the-art literature review of WP1, as well as empirical analysis of WP2-6. ECRE and Universiteit van Amsterdam will perform this task jointly.

Thematic paper on “Options for a common asylum system (harmonisation – regionalisation – externalisation)”

Based on task 2.3, a thematic paper is prepared shedding light on key features of the CEAS and generating results for further work on scenarios under WP 7. The paper analyses three options of a “common European asylum system”, representing the most dominant current streams of a potential future: a) ‘harmonised’, b) ‘regionalised’, and c) ‘externalised’. It discusses the options along considerations on the institutional set up of the CEAS and examines the gradual and increased proposed shift of asylum policy making from the national to the EU-level, and its perception by policy-makers and stakeholders, thus looking into: a) Nationalised European Asylum System, b) a shared (EU+ Member States’) Asylum System, and c) a centralised EU asylum system (e.g. EASO++).

Cross-national comparative report

Based on the data generated from tasks 5.1 to 5.3, the deliverable will identify different patterns of politicisation among EU countries and tanalyse the main drivers as well as possible consequences. In terms of drivers, we will consider under what conditions politicisation has developed in different countries. In terms of consequences, the key question is to what extent different patterns of politicisation explain different Member State positions on responsibility sharing, especially in relation to relocation schemes. The focus on both drivers and consequences will allow us to understand how the insight and contextual understanding of discourses can be translated into the development of proactive strategies (e.g. in the field of communication, civil society, education, etc.).

Comparative report on the multilevel governance of the national asylum reception systems

Mapping and analysing the stakes, goals, resources and strategies of the actors involved at different levels (national, regional, local), the role they played in the decisionmaking process beyond their formal tasks and their mutual relations, and the contextual factors which affect the reception systems. In the case of Italy and Greece, hotspots will also be considered.
As for the local level, in each country, 2 different localities with a high level of heterogeneity (in terms of population size, ruling parties, size of the third sector, similar share of asylum seekers or refugees, etc.) have to be considered.
Each partner involved will undertake 20-25 qualitative in-depth interviews with key informants, in particular policymakers, high-ranking public officials, leaders of non-profit organisations, representatives of immigrant/refugee associations if relevant.

Annotated bibliography of academic/policy analysis on asylum in the EU

The annotated bibliography will result from a bibliographic review of academic research into the common EU asylum system, with a particular focus on the politicisation of immigration and refugees in Europe and discussions on ‘burden sharing’ mechanisms. This will focus on all publications in academic journals since 2000 and incorporating working papers and public reports published since 2010. These will be collected into a shared annotated bibliography.

This working paper examines the meaning of solidarity in the context of asylum, usually debated under the term ‘responsibility sharing’. It aims to examine EU Member States’ understanding of solidarity in the context of asylum. In particular, it will investigate the EU’s initial position on solidarity among the Member States of the EU, and whether this approach has shifted over the years and in the course of the last waves of enlargement of the EU in 2004, 2007 and 2013.

Mapping of current asylum situation in EU Member States

This deliverable will map the current situation of asylum law across the EU. This will provide a simple quantitative measure of the current state of transposition of key directives into national law. This will build on the Asylum Information Database (AIDA), established by ECRE, slightly expanded to ensure that all CEASEVAL case studies will be covered. ECRE will review this document once it has been produced by UOS.

New policy database focusing on variables relevant to asylum applications in both sending and receiving countries

The deliverable consists of a new policy database, drawing on existing policy databases and new analysis, with the aim of quantitatively testing the influences on changes in asylum applications across the EU since 2000.
